Terms of Service
These terms govern your use of Mercury — the software at www.mformercury.com and app.mformercury.com, its API, CLI and MCP server (together, the “Service”). “Mercury”, “we” and “us” mean the operator of the Service; “you” means the person or company opening or using a workspace. By paying for a plan, creating an account, or using the Service, you agree to these terms.
1. Your account and workspace
- A workspace is opened by a paid checkout and the sign-up link it issues. You must give accurate details, use a work email address, and keep your password private. You are responsible for everything done in your workspace, including by people you invite.
- You must be at least 18 and able to enter a contract on behalf of the company you name. Workspace admins may invite team members and client-portal viewers; you remain responsible for their use.
- We may refuse, suspend or close accounts that breach these terms, put LinkedIn accounts or other people at risk, or are used for fraud or abuse.
2. LinkedIn and your senders
- Mercury sends invitations, messages and other actions from LinkedIn accounts you connect (“senders”). You confirm you own or are authorised to operate each sender, and that its owner knows and agrees.
- M for Mercury is not affiliated with, endorsed by or sponsored by LinkedIn Corporation. Automating a LinkedIn account may be contrary to LinkedIn’s user agreement, and LinkedIn may restrict or close accounts at its discretion. You use the Service at your own risk in that respect. Mercury provides pacing, daily limits and working-hours controls to reduce that risk, but cannot eliminate it and does not guarantee any outcome.
- Senders are connected through a hosted login provided by our connection partner; Mercury does not store your LinkedIn password.
3. Acceptable use
You will not use the Service to:
- send spam, deceptive, defamatory, harassing or unlawful messages, or contact people who have asked not to be contacted;
- process personal data without a lawful basis, or in breach of the GDPR, UK GDPR, CAN-SPAM, India’s DPDP Act or any other law that applies to you or your recipients;
- impersonate anyone, misrepresent who is sending a message, or use a sender you are not authorised to use;
- upload data you have no right to use, including scraped data obtained in breach of a site’s terms;
- probe, overload, reverse-engineer or interfere with the Service, or resell it without our written agreement (agencies may use client workspaces for their clients).
4. Plans, payment and renewal
- Plans are priced per LinkedIn sender, or as a flat fee that includes a number of senders, as shown on the pricing page at the time you buy. Prices are in US dollars and exclude any taxes you are required to pay.
- Payment is collected by Veem against an invoice we raise when you check out. Your workspace opens once Veem authorises the payment. Mercury does not receive your card or bank details.
- Plans do not renew automatically. We invoice you before the end of each monthly or yearly period; if the invoice is not paid, the workspace stops sending when the period ends and is retained for 60 days before deletion.
- Adding senders, changing plan, client workspaces, Mercury Coins and Mercury Contact Credits are invoiced for the difference or at the add-on prices shown. Included allowances reset each billing period and do not roll over; purchased top-ups do not expire while your plan is active.
- Refunds: if you tell us within 14 days of your first payment that Mercury is not right for you, we refund that first payment in full. Otherwise payments are non-refundable except where the law requires.
5. Your data
- You own the data you bring into Mercury — your audiences, leads, messages and files (“Customer Data”). You grant us the licence needed to store, process and display it to run the Service for you.
- For Customer Data about your prospects and contacts, you are the controller and Mercury is your processor, acting on your instructions as set out in the Privacy Policy, which forms part of these terms.
- Deleting a lead, audience, workspace or account permanently deletes the associated data, including messages and files, subject to backups that expire within 30 days.
6. AI features and third-party data
- AI writing, AI audience columns and similar features generate text with third-party language models. Output may be inaccurate; you are responsible for reviewing anything sent in your name.
- Find Contacts and email lookup use third-party data providers. We do not guarantee the accuracy or deliverability of any result, and you are responsible for your lawful use of it.
7. Availability, support and changes
We aim for the Service to be available continuously but do not guarantee uninterrupted operation; LinkedIn, our connection partner and other providers are outside our control. We may change or discontinue features with reasonable notice, and will not materially reduce what a paid plan includes during a period you have paid for.
8. Intellectual property
The Service, its software, design and documentation are ours or our licensors’. These terms give you a limited, non-exclusive, non-transferable right to use the Service for your business during your subscription, and nothing more. Feedback you give us may be used without obligation.
9. Warranties and liability
- The Service is provided “as is”. To the fullest extent permitted by law we exclude all implied warranties, including fitness for a particular purpose, and any warranty that outreach will produce replies, meetings or revenue, or that LinkedIn will not restrict a sender.
- To the fullest extent permitted by law, our total liability for all claims arising out of the Service in any twelve-month period is limited to the amount you paid us in that period, and we are not liable for indirect, consequential or special losses, lost profits, lost data, or the restriction or loss of a LinkedIn account.
- You will indemnify us against claims arising from your Customer Data, your messages, or your breach of these terms or of applicable law.
10. Termination
You may stop using the Service at any time and may ask us to delete your workspace. We may suspend or terminate the Service for breach of these terms, non-payment, legal requirement, or risk to other users, giving notice where practicable. Sections 5, 8, 9 and 11 survive termination.
11. General
- These terms, the Privacy Policy and the pricing page are the entire agreement between us for the Service and replace any earlier agreement.
- They are governed by the laws of India, and the courts of Chennai, Tamil Nadu have exclusive jurisdiction, without prejudice to any consumer rights you cannot waive where you live.
- We may update these terms; material changes will be announced in the app or by email at least 14 days before they take effect. Continued use after that date is acceptance.
